That's 39 floors, as floors are typically defined for high rise buildings (excluding the mechanical floors). If you want to add mechanical floors to the count you'd have to add them to almost every high rise in the city. Charlie West, 1 Victoria, Young Condos, Breithaupt Block, etc all have 1-2 mechanical floors on top of the official floor count.

Yah true, I always thought however for true height of building you measure to architectural tip. Which includes any mechanical, spires, but not any antennas or radio masts. (Imo I think spires are kindof cheating) Eg. St Regis in Toronto or One World Trade in NYC. This is how all the websites are measure, Skyscraper City, Emporis etc

If you're measuring building height in meters then yes, that's the convention, but floor counts are separate from that. You'd say that DTK Condos is 128m/39fl.
That diagram appears to have some pretty wrong height markings though, the machine room at 571m makes the building taller than the CN Tower.

I think those are elevations. 0 is not at ground level. That being said, the top one is about 100m lower than the ones near it, so not sure what is going on there.
Anyway, the CN Tower isn’t that tall. What, maybe 12-15 floors or so?

I know that the building is not looking so fly (god forbids the podium), but I’m just happy we’re getting 40+ floor building in Kitchener Waterloo.

It's 39 floors. Mechanical penthouses aren't really factored into the floor count at the end of the day. Technically they're floors, but when we talk about building floor counts in architecture, you only count the amount of usable/livable floors (though if you have, say a couple levels of above ground parking, that is often included).
When measuring building height, you can do it two ways. Well, in architecture we measure everything. But when representing height to the public, the standard is to measure to the top of the building (which includes mechanical penthouses). At times, however, things like spires, antennas and so on are included. This is only ever done for bragging rights since we wouldn't really consider an antenna as being part of the building. Spires are different, but usually we differentiate between actual building height and height including the spire.
Architectural drawings can be confusing to understand at first. Autodesk has a good page on AutoCAD (which is primarily what firms in North America use - Europe prefers ArchiCAD), with lots of pages on the meanings of drawings and how to understand them. Architizer has a good list of various symbols that you see in drawings as well. The entire Practice page has great resources for learning all about how architecture is produced if you're curious.

For definition, yes, the building is 39 floors. However, if I was to take a picture/video while standing on the rooftop, the original reference to "from 42 stories high" would also be correct.
