The developer is not being a good neighbour - the fence is taking up space on the sidewalk, while the boulevard strip next to the sidewalk on the other side is overgrown with very tall weeds. (I'm not being facetious in the least, you're right that it's not neighbourly, that's the only way it's taken care of, and most people do not let bylaw know about these things even when it bothers them.)
